RE: BREXIT IS IMPASSE WITHOUT A NEW REFERENDUM
OR GENERAL ELECTION
Suggestion:
Hon.
Prime Minister, let me start by paying my respects to you and through you to. Well,
you have got further extension of Article 50. I hope that further extension of
Article 50 cannot undermine the regular functioning of the EU and its
institutions. The European Parliament election is to be held between 23 May
2019 and 26 May 2019. If the UK continuing EU member states and not ratified
the EU Withdrawal Agreement by May 22, 2019, the UK has to hold the European
Parliament elections in accordance with the EU law. But I have a doubt that
European Parliament election will take place in the UK. I think Article 50
short extension won’t require the UK to participate in the European Parliament
election 2019. If the UK wants to send MEPs to European Parliament it will have
to repeal part of its repealing legislation according to Schedule 9 of the EU
Withdrawal Act 2018 repeals both the European Parliament Representation Act
2003 and the European Union Parliamentary Elections Act 2002 with effect from
July 4, 2018. However, EU and its institutions are not paying much attention to
the legal treaties of Article 50 which provides two year time frame to leave
the EU. It doesn’t say indefinite time to leave the EU. I have a doubt that
Article 50 extension could be vulnerable to legal challenge. Let’s see the EU
and its institutions should act in a responsible manner throughout the Article
50 extension. The EU and its institutions are showing goodwill to the UK as UK
is the member of the EU since 1973. The
European Council is giving Article 50 extension to the UK’s
for soft BREXIT or revocation of Article 50.
Hon.
Prime Minister, I kept on insisting that BREXIT is a huge mess since April 2016.
I haven’t seen any easy ways of clearing up this BREXIT issue in next six
months time frame. Moreover, the UK still doesn’t know what it wants from the
EU and its institutions. I don’t think that the EU will reopen the Withdrawal
Agreement. The EU and its institutions has negotiated with the UK very well by
implementing the Withdrawal Agreement before the future trade deal with the EU.
I would like to suggest at least consider former Director-General of the WTO
Mr. Pascal Lamy, accepting four freedoms including freedom of movement which
will resolve the Northern Ireland border as well as the UK’s economic issues. According
to Migration Advisory Committee, free
movement of the EU citizens who’s contributes public finance much higher than non-EU
as well as average British. The EU migrants make positive public finances and
integrate culturally well compare to non-EU migrants, if I am not mistaken. We
need to analyse on the different types of immigration is much needed here.
According to ONS, net migration into the UK from non-EU almost five times
higher than the EU net migration from September 2017 to September 2018.
Migration is a small issue. In the US, New York a citizen does not bother Texas
citizens moving its borders every year. It is still happening. It can be
addressed but the UK is cutting off from the world’s largest market (EU Single
Market) for small part of the migration issue. We need to address the migration
issue not the EU regulatory and trade orbit.
Hon.
Prime Minister, if you want further extension, I am quite sure that the EU will
offer long extension of Article 50 with stringent conditions like the UK to
either hold a new referendum or general election. IMHO, a long extension is imperative
in which the UK can come up with new BREXIT strategy about what is best for the
UK. I just heard from the UK media Telegraph “Article 50 extension is illegal
and will be challenged in the courts.” The UK courts has no rights over the
extension of Article 50 but the European Council has full control over the
extension of Article 50 to grant it or not because the European Council is
fully responsible to protect the EU if any damages done to the EU from
disruption by the UK. The European Council allowed the UK Article 50 extension
to sort out the BREXIT consequences of its own governmental incapacity to
decide BREXIT issue. If we want to make the UK or any EU member states a better
place in the world then perhaps starts with being a little courteous. The
European Council is doing the same. Moreover, the UK is still the member of the
EU. It is the duty of the EU to save its member states. It would be mistake to
take the Article 50 extension that the European Council will allow numerous
further extensions. The Chief BREXIT Negotiator of the EU Mr. Barnier suggested
that the EU might not agree to a long Article 50 extension unless you are
willing to embrace the EU Customs Union. I would like to highlight here, the
ECJ ruled that revocation of Article 50 would probably be accompanied by the UK
request for a new referendum and Article 50 revocation is only possible if it
is genuine. I am sure that you are so reluctant to revoke Article 50 or a new
referendum as it would be abandoning BREXIT but still a new referendum or
general election is two mechanisms that solved BREXIT impasse. You cannot revoke
Article 50 without a clear national consensus. It will be fraught with
difficulties both in the UK and the EU. You may entitle to apply the royal
prerogative in revoking Article 50 but you might seek House of Commons approval
for political reasons. That is why I suggested going through a second
referendum is the only mechanism that resolve BREXIT impasse. I have been
insisted you quite long time. The UK cannot afford BREXIT in any form in
economically or socially or politically. Even soft BREXIT have clearly visible
economic, social and geopolitical consequences but it will cause minimal
damage. The UK’s current term is always being the best outcome. I keep
insisting that UK democracy operating to an advisory policy proposal (advisory
referendum) makes the UK poorer, weaker, less relevant nation in the world.
What happens if your government doesn’t get BREXIT deal on or before October
31, 2019? Let me put it very clearly, leaving the EU need to be follow by the
years of negotiations without a new referendum or general election. BBC
reported that you are not considering general election. It is fine. I most
humbly prayed you to at least consider a new referendum. Recent polls suggested
that majority British would prefer no BREXIT at all. At present the UK leaving
the EU would thus seem to be undemocratic without a new referendum. New
referendum would preserve the UK deep and special relationship with the EU. The
ball is in your court as the Prime Minister of the UK. I want you to act
fearlessly so that you will gain reputation and stature in the world community.
Thank
you very much for your attention Hon. Prime Minister.
Have a wonderful walking holidays in Wales!
Respectfully
yours
Athinarayanan
Sanjeevraja.
